Ngành công nghiệp thiết bị y tế là một tích hợp về y học sinh vật, vật liệu, máy móc , thiết bị điện tử và kỹ thuật lĩnh vực khác theo yêu cầu ngành, cùng với sự phát triển kinh tế và mức sống con người ngày càng cao, xã hội già hóa đang đến gần, các bệnh mãn tính tăng lên và tăng nhu cầu về chăm sóc sức khỏe , đặc biệt là trong những năm gần đây lĩnh vực y tế sắc đẹp bùng nổ, thiết bị y tế chỉnh hình, nhu cầu ngày càng tăng. Sự phát triển của thiết bị y tế không chỉ là đánh giá hiệu quả của thiết bị, mà còn đảm bảo sự an toàn của việc sử dụng. Khử trùng thiết bị y tế cần phải chọn một cách cẩn thận thích hợp nhất để khử trùng, và thực sự bởi hiệu quả khử trùng và kiểm soát chất lượng để đảm bảo rằng các sản phẩm đáp ứng yêu cầu khử trùng.
Hệ thống quản lý chất lượng thiết bị y tế ISO 13485 thuộc về hệ thống quản lý chất lượng ngành công nghiệp các thiết bị y tế, ISO 13485 do Uỷ ban Kỹ thuật quản lý Chất lượng thiết bị y tế ISO / TC 210 biên soạn, lấy tiêu chuẩn quốc tế làm chuẩn, quy định một cách rõ ràng chỉ ra rằng các nhà sản xuất về chất lượng phải phù hợp với các tiêu chuẩn, khiến cho các thiết bị y tế và các dịch vụ liên quan phải phù hợp với các quy định pháp luật và yêu cầu của khách hàng. ISO 13485 là một tiêu chuẩn độc lập, trong đó có nguồn gốc từ cơ cấu của tiêu chuẩn ISO 9001, việc lược bỏ một số các yêu cầu không phù hợp của tiêu chuẩn ISO 9001 là yêu cầu của quy định pháp luật, và thêm một số yêu cầu cụ thể cho các thiết bị y tế. Hiện tại, nhiều quốc gia trên thế giới dựa vào tiêu chuẩn này để xác minh đầu vào của sản phẩm. Do đó, các thiết bị y tế cần phải được FDA chấp thuận cho việc liệt kê các thiết bị y tế trước khi đưa lên thị trường và tiêu thụ.
Cục Quản lý Thực phẩm và Dược phẩm (Food and Drug Administration, FDA) chịu sự quản lý của Dịch vụ Y tế Công cộng (Public Health Service) thuộc Bộ Y tế và Dịch vụ nhân sinh Hoa Kỳ (U.S. Department of Health and Human Services) , chịu trách nhiệm kiểm tra và kiểm soát việc tiêu thụ về thực phẩm, dược phẩm, mỹ phẩm và thiết bị y tế.
Ở Hoa Kỳ, quản lý thiết bị y tế, được chia thành 3 cấp ( tổng cộng 16 loại, 1700 loại). Nguyên tắc phân loại được ghi trong mục 513 của Luật FD &C Act, sự khác biệt 3 cấp như sau:
Class Ⅰ- Loại 1, Kiểm soát chung (General Controls). Các thiết bị y tế như vậy cần phải được đưa ra thị trường thông qua các thủ tục kiểm soát chung để đảm bảo tính an toàn và hiệu quả của chúng. Chẳng hạn như nạng, kính, băng v.v...
Class Ⅱ- Loại 2, Kiểm soát đặc biệt (Special Controls). Ngoài các thủ tục kiểm soát chung của Class Ⅰ, tuy nhiên theo các yêu cầu đặc biệt của một thiết bị y tế FDA, hoặc theo sự phát triển của ngành công nghiệp tiêu chuẩn được chấp nhận trên toàn cầu (ví dụ như ISO, IEC, vv). Trong số các yêu cầu đặc biệt của FDA là các tiêu chuẩn bắt buộc đối với các sản phẩm cụ thể (mandatory performance standards), đăng ký của bệnh nhân và giám sát sau khi lên thị trường. Các sản phẩm này bao gồm găng tay y tế, xe lăn điện, thiết bị trợ thính, máy đo huyết áp, chẩn đoán catheter và v.v...
Class Ⅲ- Loại 3, chứng nhận trước khi đưa lên thị trường. Mục đích chính của thiết bị y tế như là duy trì cuộc sống hoặc dài hạn cấy vào cơ thể, có khả năng gây nguy hiểm cho bệnh nhân, có thể gây ra chấn thương hoặc bệnh tật, vì thế, cần phải có được PMA (Premarket Approval) của FDA trước khi đưa ra thị trường. Các sản phẩm như vậy bao gồm điều chỉnh nhịp tim, thiết bị tử cung và hộp giữ nhiệt cho trẻ sơ sinh.
Tại Hoa Kỳ, tất cả các thiết bị y tế có trong quản lý Thực phẩm và Dược phẩm Hoa Kỳ (Food and Drug Administration, FDA) quy định, theo mức độ gây hại khác nhau, chia thành 3 cấp độ kiểm soát, EU, Nhật Bản và Canada và các nước khác đều được dựa trên hệ thống quản lý khái niệm này để kiểm soát thiết kế hệ thống thiết bị y tế quản lý của mình. Do vậy, các nhà sản xuất trong các sản phẩm xuất khẩu trước đây, đều phải làm 3 việc: " xác nhận sản phẩm là một thiết bị y tế", "xác nhận sản phẩm là loại 1, loại 2 hay loại 3 ", " trong loại thiết bị này có cùng loại hoặc tương tự các sản phẩm riêng của họ có những quy định kiểm soát nào" để tạo điều kiện hiểu biết về các ngành công nghiệp, tổng hợp các thiết bị y tế tại Hoa Kỳ liệt kê như sau.:
1. Thông báo trước khi lên thị trường (Premarket Notification), dựa vào FD & C Act, quy định Mục 510 (gọi tắt là 510 (k)) về đăng ký FDA, FDA xác định rằng các thiết bị so với các thiết bị có trên thị trường có tương tự không "Tính thực chất ngang bằng (Substantial Equivalence )", nhà sản xuất phải nộp bằng chứng để chứng minh vật liệu, nguyên lý chế tạo hoặc sửa đổi thiết bị, sẽ an toàn và hiệu quả, sau khi được sự chấp thuận của FDA, các nhà sản xuất phải căn cứ vào quy định thực hành sản xuất tốt (GMP) để sản xuất;
2. Các thiết bị loại 3 (thuộc loại ba hoặc 510 (k) kiểm tra tính không đầy đủ thực chất sản phẩm), nên tuân thủ đăng ký trình tự kiểm tra trước khi đưa lên thị trường (Premarket Approval,PMA).
3.Thông qua thông báo FDA không cần đăng ký sản phẩm 510 (k), nhà sản xuất chỉ cần làm theo các quy định khác của sản phẩm có thể thâm nhập thị trường Hoa Kỳ.
Thị trường thiết bị y tế Đài Loan do Cơ quan chủ quản y tế (Sở Y tế ở cấp trung ương; ở thành phố trực thuộc thì do chính phủ trực thuộc, ở quận / thành phố thì do chính phủ quận / thành phố, Điều thứ 2 Luật dược phẩm) , Dựa vào sở y tế của Trung Hoa Dân Quốc (gọi tắt là Sở y tế) ban hành Điều 13 luật Dược phẩm: “Định nghĩa về hệ thống thiết bị y tế, bao gồm chẩn đoán, điều trị, giảm thiểu hoặc trực tiếp phòng ngừa các loại bệnh , hoặc đủ để ảnh hưởng đến cấu trúc cơ thể con người và chức năng của công cụ, dụng cụ, thiết bị và các phụ kiện, phụ kiện, linh kiện.” Việc phân loại thiết bị y tế của Đài Loan dựa trên các tiêu chuẩn của FDA, được chia thành 17 loại <mô tả dưới đây>, thiết bị y tế mới phải được thực hiện lâm sàng.

Theo Luật Dược phẩm và các luật , quy định có liên quan như quản lý thiết bị y tế, nhà máy sản
xuất dược phẩm thiết lập ký hiệu của nhà máy và quản
lý khác. Có ba hoạt động cơ bản trong ngành thiết bị y tế địa phương: sản
xuất, nhập khẩu và tiêu thụ (cùng một nhà sản
xuất có thể có nhiều hơn 2 góc độ), cơ cấu quản lý thông thường như sau:

Thiết bị y tế Hệ thống chất lượng của nhà sản xuất nước ngoài phải tuân thủ Thực thi sản xuất tốt (GMP) cho các thiết bị y tế. Tất cả các văn kiện Hệ thống chất lượng QSD (Quality System Documentation) chuẩn bị những tài liệu gốc phù hợp, có liên quan với thiết bị y tế (GMP), Quy định thực thi sản xuất tốt thiết bị y tế của Trung Quốc căn cứ vào quy định liên quan của Luật Dược phẩm trong nước, tiêu chuẩn Trung Quốc CNS 12681 (ISO 9001) và hệ thống đảm bảo chất lượng thiết bị y tế theo tiêu chuẩn quốc tế (ISO 13485) tạo nên. Yêu cầu các nhà sản xuất thiết lập một hệ thống chất lượng để đảm bảo chất lượng sản xuất. Dựa vào “ Quy định thực thi sản xuất tốt các thiết bị y tế (GMP) và các mục được liệt kê trong điều 2 "Yêu cầu của Hệ thống Chất lượng" bao gồm các mục sau:

ISO 13485
quality management system for medical devices is dedicated to the quality
management system in the medical device industry. ISO 13485 is an ISO / TC 210

associated services. ISO 13485 is an independent standard whose main structure

medical equipment. This standard includes the basic safety requirements, risk
analysis / management, clinical evaluation / investigation, labeling, other
technical standards, and information feedback system, post-listing supervision,
customer complaint investigation, alert system, advisory notice, etc. In

design management, environmental control, special process control,
traceability, record keeping and regulatory measures. At present, many

The FD & C
Act definition of medical devices in the United States is clearly defined in FD
& C Act.201 (h): "The so-called medical devices are instruments,

States, all medical devices are included in the control of the Food and Drug
Administration (FDA) and are regulated in three levels according to the degree

Good Manufacturing Practice (GMP) for Medical Equipment in China. Imported
medical equipment <Manufacturing plants other than Taiwan> Prior to
listing, agents in Taiwan prepare the Quality System Document (Quality System
Document) and submit them to DH for review. QSD is one of the ways in which
medical equipment importers can apply for medical equipment GMP. At the time of
application, an application should be submitted to the Department of Health of
the Executive Yuan for examination by a drug dealer that owns a license for the
manufacture or sale of drug business license in our country. The fee should be
paid and two copies of the application form and submission materials should be
filled in. QSD Department of the factory as a login, should be based on
different factory locations individually
The so-called
quality system documentation QSD (Quality System Documentation) refers to the
original with the Medical Device Good Manufacturing Practice (GMP) of the
relevant information, China's excellent manufacturing standards for medical
equipment in accordance with the relevant provisions of the Pharmacopoeia,
China National Standards CNS 12681 (ISO 9001) and medical equipment quality
assurance system of international standards (ISO 13485) set. Require

In order to
confirm the normal operation of medical equipment and ensure its safety without
any adverse impact on the human body or the environment, and to verify its
efficacy and maintain a high standard of medical service, medical equipment
manufacturers should adopt more stringent management System for the overall
quality management of product design, development, production, installation and
service to ensure the safety, efficacy and consistency of medical equipment.
The global
market for medical devices in 2010 was US $ 245.6 billion. The Americas is
currently the largest regional market for medical materials, accounting for
44.1% of the global medical material market. However, mainland China will be
affected by the implementation of the new health care reform system and the
12th Five-Year Plan, which will drive the market opportunity for medical
equipment. It is estimated that there will be potential in 2015 to grow from
the world's 7th largest medical equipment market to the fourth largest medical
consumer market . Russia's medical equipment market in 2010 compared with the
previous year have a greater growth rate, highly dependent on imports of

supportive strength, the expected growth trend will be more obvious.

醫療器材產業是一種整合生物醫學、材料、機械及電子等跨領域技術的民生必需工業,隨著經濟發展與生活水準的提高,高齡化社會來臨、慢性病人口逐漸增加及健康照顧需求逐漸增加,由其是近年來醫學美容領域蓬勃發展,整形外科醫療器材之需求與日俱增。醫療器材開發不僅需評估器材的使用功效,同時也必須確保其使用之安全性。對於有滅菌需要之醫療器材必須慎選適當的滅菌方式以進行滅菌,並藉由滅菌確效及品質控制以確保產品達到滅菌需求。
ISO 13485醫療器材品質管理系統專屬於醫療器材行業中的品質管理系統,ISO 13485係由ISO/TC 210醫療器材品質管理技術委員會所編擬,為國際認可的標準,條文中明確的指出廠商在品質管理系統中所需要達到的標準,使其醫療器材以及其相關的服務是一貫地符合客戶及法規的要求。ISO 13485是一個獨立的標準,其條文主要結構是源自於ISO 9001,刪減了ISO 9001中不適於作為法規要求的某些要求,並加入一些關於醫療器材的特定要求。本標準包括安全上的基本要求,風險分析/管理、臨床評估/調查、標示、其他技術標準,以及資訊回饋系統,上市後的監督,客戶抱怨調查,警戒系統,建議性通告等,除此之外,對某些條款亦有額外的要求如:設計管理、環境管制、特殊流程管制、追溯性、紀錄保存及法規措施等。目前世界各國多依此規範審核產品輸入,若能通過此標準之認證,表示您的產品已得到客戶的信任。
美國FD&C Act對醫療器材的定義在FD&C Act.201(h)中有明確定義:「所謂醫療器材是指符合以下條件的儀器、裝置、工具、機具、器具、插入管、體外試劑或其他相關物品,包括組件、零件或附件等:明列於官方National
Formulary或美國藥典(the United
States Pharmacopeia)或前述二者的附件中者;意圖使用於動物或人類疾病或其他身體狀況的診斷;或用於疾病之治癒、減緩、治療者;意圖影響動物或人類身體的功能或結構,但不經由動物或人類身體或身體上的化學反應來達成其首要目的,同時也不依賴新陳代謝來達成其主要目的」。因此醫療器材需獲得FDA的醫療器材上市核可,方可銷售。
美國食品藥物管理局((Food and Drug Administration
, FDA) 隸屬於美國國務院保健與服務部(U.S. Department
of Health and Human Services)的公共健康服務署(Public Health Service),是負責檢查和控制銷售給消費者的食物、藥物、化妝品和醫療器的法定機構。
在美國醫療器材管理上,其分為3等級〈共16大類,1700種〉。分類的原則撰寫在FD&C Act 第513節,3等級分別為:
Class Ⅰ,一般管制(General Controls)。此類的醫療器材只需要藉由一般管制程序來確保其安全性與功效性即可上市。如拐杖、眼鏡片、膠布等
Class Ⅱ,特別管制(Special Controls)。除了Class Ⅰ的一般管制程序外,尚須遵循FDA為某項醫療器材所制訂的特別要求或者遵循全球公認的工業界標準(如ISO、IEC等)。在FDA的特別要求中,對特定產品另有強制性的標準(mandatory performance standards)、病患登記及上市後監督等。此類產品包含醫用手套、電動輪椅、助聽器、血壓計、診療導管等
Class Ⅲ,上市前許可。此類醫療器材因主要用途為維持生命或長期植入體內,對病患具有潛在危險,可能引起傷害或疾病者,故風險較高,需要取得FDA的PMA(Premarket Approval)後才可以販售。此類產品包含心律調節器、子宮內器材及嬰兒保溫箱等。
在美國,所有的醫療器材都列入美國食品藥物管理局((Food and Drug
Administration , FDA)的管制,依據個別器材的危害程度不同,分為3等級來管制,歐盟、日本和加拿大等國都是以這種系統化管理的概念來設計其醫療器材管理制度。因此,製造商在把產品外銷前,應先做好三件事:「確認產品是否屬於醫療器材」、「確認產品屬於第一類、第二類或第三類器材」、「在這一類器材中與自己產品相同或類似的產品有那些管制規定」。為便於業者了解,彙整醫療器材在美國上市的途徑說明如下:
1. 上市前通知(Premarket
Notification),根據FD&C Act第510節的規定〈簡稱為510(k)〉向FDA申請,FDA會判斷該器材是否與已經上市的相同器材具有「實質相等性(Substantial
Equivalence)」,製造商應提出佐證,證明該器材的修正或製造原理、材料會使其具有安全性與功效性,經FDA同意後,製造商必須依據優良製造規範(GMP)的要求來製造;
2. 第三級器材(原屬第三級或經510(k)審查不具實質相等性的產品),應遵循上市前審查(Premarket Approval,PMA)程序申請。
3. 經FDA公告毋須申請510(k)的產品,製造商只要遵守其他規定就可以將產品銷入美國市場。
台灣對於本地醫療器材市場是由衛生主管機關(在中央為行政院衛生署;在直轄市為直轄市政府;在縣/市 為縣/市政府, 藥事法第2條)管轄,依中華民國行政院衛生署(以下簡稱衛生署)頒布之藥事法第13條:「醫療器材之定義,係包括診斷、治療、減輕或直接預防人類疾病,或足以影響人類身體結構及機能之儀器、器械、用具及其附件、配件、零件」。台灣對於醫療器材的分類是以FDA的標準為依據,分成17類〈說明如下〉,新醫療器材一定要做臨床。
(1)臨床化學及臨床毒理學 (2)血液學及病理學 (3)免疫學及微生物學
(4)麻醉學 (5)心臟血管醫學 (6)牙科學
(7)耳鼻喉科學 (8)胃腸病科學及泌尿科學 (9)一般及整形外科手術
(10)一般醫院及個人使用裝置 (11)神經科學 (12)婦產科學
(13)眼科學 (14)骨科學 (15)物理醫學科學
(16)放射學科學 (17)其他經中央衛生主管機關認定者。
依據藥事法及各項相關法規如醫療器材管理辦法、藥物製造工廠設廠標準等,進行管理。對本地醫療器材產業中三種基本活動: 製造、輸入、販賣(同一廠商可兼具兩種以上角色),一般之管理架構如下:

醫療器材國外製造業者之品質系統須符合我國醫療器材優良製造規範(GMP)。輸入之醫療器材〈非台灣地區之製造廠〉上市前,由台灣地區之代理者,備齊衛生署規定之相關文件(Quality System
Document,品質系統文件),送衛生署審查,通稱QSD審查。 QSD乃為醫療器材輸入業者申請醫療器材GMP之評鑑方式之一。申請時,應由我國持有製造或販賣業藥商許可執照之藥商,繳納費用並填具申請書表二份及送審資料,向行政院衛生署申請檢查。QSD 係以製造廠作為登錄,應依不同製造廠廠址個別申請
所謂品質系統文件QSD(Quality
System Documentation)即指原廠具備符合醫療器材優良製造規範(GMP)的有關資料,我國之醫療器材優良製造規範依據我國藥事法相關規定、中國國家標準CNS 12681 (ISO
9001)及醫療器材品質保證制度國際標準(ISO 13485) 訂定。要求製造業者建立品質系統,確保製造品質。根據「醫療器材優良製造規範(GMP)」第二點「品質系統之要求」所列之各項包含:

為了確認醫療器材能正常運作,並確保其安全性而對人體或環保不會造成任何不良影響與傷害,進而驗證其功效性並維持高品質的醫療服務水準,醫療器材廠商應以更嚴謹的管理制度,針對產品之設計、開發、生產、安裝與服務進行全面品質管理,以確保醫療器材之安全性、功效性與品質一致性。
2010年全球醫療器材市場規模為2,456億美元,美洲地區是目前最大的醫材消費區域市場,約佔全球醫材市場44.1%。然而,中國大陸受到實施新醫改制度以及十二五規劃的影響,將帶動醫療器材的市場契機,預估2015年將有潛力從全球第七大醫療器材市場,攀升成為第四大醫材消費市場。俄羅斯醫療器材市場在2010年較前一年有較大的成長幅度,在高度仰賴醫材進口與經濟狀況好轉等利多的支撐力道之下,預估成長趨勢將更為明顯。
