FDA kiểm tra hệ thống
kiểm soát chất lượng cho tất cả các công ty đăng ký. Cơ sở để kiểm tra tại chỗ

FDA Quy dd Hệ thống chất lượng QUALITY SYSTEM REGULATION - phiên bản Trung Quốc
(QSR820), mô tả các yêu cầu thực tế sản xuất hiện nay (CGMP) trong tiêu chuẩn
hệ thống chất lượng này yêu cầu đặc điểm kỹ thuật của tất cả các thiết bị y tế
đã hoàn thành việc thiết kế, sản xuất, đóng gói ,. Các phương pháp, phương tiện,
và các điều khiển sử dụng trong ghi nhãn, lưu trữ, lắp đặt, và dịch vụ. Các yêu
cầu này nhằm đảm bảo tính an toàn và hiệu quả của các sản phẩm thiết bị y tế và
tuân theo Luật thực phẩm, dược phẩm và mỹ phẩm Hoa Kỳ. Bản quy định này nêu ra
các yêu cầu cơ bản áp dụng cho các nhà sản xuất các sản phẩm thiết bị y tế. Nếu
nhà sản xuất chỉ thực hiện một phần các hoạt động được quy định trong quy định
này mà không thực hiện các hoạt động khác, nhà sản xuất chỉ cần thực hiện những
yêu cầu áp dụng cho các hoạt động mà mình thực hiện. Đối với thiết bị loại I,
việc kiểm soát thiết kế được thực hiện chỉ theo các yêu cầu được nêu trong
§820.30 (a) (2).
1.1 Tổng quan
§820.1 Phạm vi
(a) Khả năng áp dụng
(1) Trong quy định hệ thống chất lượng này được mô tả trong các yêu cầu thực tế
sản xuất hiện nay (CGMP). Đặc điểm kỹ thuật này đòi hỏi của tất cả các thiết bị
y tế đã hoàn thành việc thiết kế, sản xuất, đóng gói, dán nhãn, bảo quản, lắp
đặt và dịch vụ phương pháp sử dụng , cơ sở vật chất, và kiểm soát. Các yêu cầu
này là để đảm bảo rằng thiết bị y tế an toàn và hiệu quả của sản phẩm đã hoàn
thành, và tuân thủ các quy định thực phẩm, dược phẩm, và mỹ phẩm Hoa Kỳ. Bản
quy định này đưa ra các yêu cầu cơ bản cho các thiết bị sản xuất sản phẩm y tế.
Nếu một nhà sản xuất chỉ tiến hành một hoạt động của bản quy định này mà không
thực hiện các hoạt động khác, nhà sản xuất chỉ cần áp dụng đối với những yêu
cầu mà hoạt động cần. Có liên quan đến thiết bị loại I, khống chế thiết bị được
liệt kê trong yêu cầu §820.30 (a)(2). Tiêu chuẩn này không áp dụng với linh
kiện nguyên kiện của nhà sản xuất, nhưng khuyến khích các nhà sản xuất như sử
dụng một đặc điểm kỹ thuật làm hướng dẫn. Nhà sản xuất các sản phẩm về máu và các thành phần máu
con người không thuộc vào phạm vi quản lý của quy định này, nhưng là thuộc Phạm
vi quản lý của 606.
(2) Quy định này áp dụng đối với thiết bị y tế đã được xác định trong quy định
này, và do con người sử dụng, ở bang Mỹ hoặc vùng lãnh thổ, hoặc District of
Columbia, Liên bang Puerto Rico đặc biệt sản xuất, nhập khẩu hoặc xuất khẩu các
thành phẩm thiết bị.
(3) Trong quy định này, nhiều lần sử dụng cụm từ "nơi thích hợp." Khi

(4) Phạm vi
Tiêu chuẩn và bổ sung hệ thống chất lượng này ngoại trừ quy định tại phần khác
nêu rõ quy định về các khía cạnh khác. Không phải là có thể thực hiện tất cả
các quy định hiện hành (bao gồm cả phần này và các phần khác của điều khoản quy
định này), các quy định cụ thể áp dụng cho các thiết bị có vấn đề sẽ thay thế các
điều khoản thông dụng khác.
(5) Các quyền hạn
Luật liên Bang 501, 502, 510, 513, 514, 515, 518, 519, 520, 522, 701, 704, 801,
803, (21U.SC315, 352, 360, 360C, 360D, 360e, 360h, 360i, 360j, 360l, 371, 374,
381, 383) và đề nghị thành lập 820 đặc điểm kỹ thuật có thẩm quyền. Nếu bạn
không thực hiện các chi tiết kỹ thuật được áp dụng, nó có thể dẫn đến thiết bị
giả hoặc kém chất lượng, có thể sẽ dẫn đến phát sinh máy móc không hợp lệ, theo

(6) Nhà sản xuất nước ngoài
Nếu một số nhà máy sản xuất nhập khẩu máy móc thiết bị vào Hoa Kỳ, từ chối chấp
nhận FDA kiểm tra các thiết bị nước ngoài là có phải thực hiện quy định tiêu
chuẩn này hay không, thì sẽ xuất hiện hậu quả trong quy định 801 (a). Dùng bất
cứ máy móc nào của sự sản xuất thiết bị như vậy, trong việc thiết kế, sản xuất,
đóng gói, dán nhãn, lưu trữ, cài đặt hoặc dịch vụ, sử dụng phương pháp này, và
một bộ máy kiểm soát đều chưa thực hiện theo quy định của 520 (f) . Theo quy
định 501 (h), Thiết bị được sản xuất với linh kiện như vậy là một sản phẩm giả
hoặc kém chất lượng.
(7) Miễn hoặc thay đổi
(a) Bất kỳ đơn đề nghị hy vọng miễn hoặc thay đổi việc chấp hành hệ thống chất
lượng thiết bị nào đó , phải tuân thủ các quy định yêu cầu 520 (f) (2). Quá
trình đề nghị miễn, thay đổi sẽ được dựa trên quy định §10.30 của chương trình,

(b) Khi FDA xác định rằng một số thay đổi khi có lợi cho sức khỏe cộng đồng, sẽ
được soạn thảo và thông qua sự thay đổi này. Sự thay đổi này chỉ có thể được
duy trì hiệu lực trong một khoảng thời gian, có nghĩa là, khi đáp ứng nhu cầu
sức khỏe cộng đồng, và nếu không có sự thay đổi , thiết bị không thể được sản
xuất trong thời gian hiệu quả.
§820.3 Định nghĩa
(a) Luật được chỉ ra là bản sửa đổi chính thức về thực phẩm, dược phẩm và mỹ
phẩm Hoa Kỳ (secs.201 ~ 903, 52Stat.1040 et seq., Phiên bản sửa đổi 21U.SC321 ~
394). Tất cả định nghĩa được xác định trong 201 đều phù hợp với quy định tại
luật này.
(b) Khiếu nại được chỉ là một số hình thức trên giấy tờ, điện tử hoặc bằng lời
nói để biểu đạt ý kiến, cho rằng các thiết bị sau khi phân phối được giám định,
chất lượng, độ bền, độ tin cậy, an toàn, hiệu quả hoặc hiệu suất có sai
sót.
(c) Tổ chức được chỉ là các thành phần tham khảo nguyên vật liệu, vật chất, các
bộ phận nhỏ, bộ phận, phần mềm, phần cứng, nhãn hoặc phụ tùng cho các thiết bị
hoàn chỉnh có đóng gói và dán nhãn.
(d) Mã số được khống chế là có số hiệu khác nhau, ví dụ như chữ mẹ đẻ hoặc số
tổ hợp, hoặc phân ban dựa vào sự khác nhau giữa số hiệu sản xuất như ban đầu,
đóng gói, dán nhãn và phân phát đơn hoặc số lượng thành phẩm .
(e) Hồ sơ lịch sử thiết kế (DHF) đề cập đến hồ sơ mô tả quy trình thiết kế sản
phẩm hoàn chỉnh của thiết bị y tế.
(f) Đầu vào thiết kế đề cập đến các yêu cầu vật lý và đặc tính của thiết bị như
là một cơ sở cho thiết kế dụng cụ thiết bị.
(g) Sản lượng thiết kế đề cập đến kết quả thiết kế ở từng giai đoạn thiết kế và
kết quả thiết kế cuối cùng. Kết quả thiết kế hoàn thành bao gồm thiết bị, đóng
gói và ghi nhãn, hồ sơ tổng thể của thiết bị.
(h) Đề cập đến một bài đánh giá thiết kế rộng, việc xem xét thiết kế phù hợp
với hệ thống , để đánh giá sự phù hợp của các yêu cầu thiết kế, và khả năng
thiết kế đánh giá đáp ứng các yêu cầu này, xác định các vấn đề.
(i) Ghi chép lịch sử thiết bị (DHR) là một hồ sơ về quy trình sản xuất của một
thiết bị y tế thành phẩm.
(j) Bản ghi máy chủ (Device Master Record - DMR) là bản ghi đầy đủ của chương
trình và ghi chép đầy đủ của các quy định.
(k) Thành lập là chỉ định nghĩa, tệp (bằng văn bản hoặc điện tử) và tình huống
thực hiện.
(l) Thành phẩm thiết bị là chỉ phù hợp sử dụng hoặc thiết bị có công năng hoặc
phụ kiện thiết bị, bất luận là có phải đã thông qua đóng gói, nhãn dán hoặc khử
trùng hay không.
(m) Lượng là chỉ một loại hoặc nhiều loại tổ hợp, hoặc thành phẩm thiết bị có một
thành phần đơn lẻ hoặc loại, model, chủng loại, kích thước, thành phần, hoặc
phiên bản phần mềm, phải được sản xuất trong cùng điều kiện và có cùng chất
lượng và đặc điểm trong giới hạn quy định.
(n) Trách nhiệm quản lý nghĩa là nhân viên cao cấp của nhà sản xuất có quyền
thiết lập hoặc thay đổi chính sách chất lượng và hệ thống chất lượng của nhà
sản xuất.
(o) Nhà sản xuất có nghĩa là người thiết kế, sản xuất, xây dựng, lắp ráp hoặc
chế biến . Các nhà sản xuất bao gồm, nhưng không giới hạn ở những người trong
quá trình cài đặt khử trùng, ghi lại nhãn, tái chế, đóng gói lại hoặc phát
triển Specification và đại lý ban đầu của thực thể nước ngoài làm các công việc
này .
(p) Sản phẩm phụ của quá trình sản xuất liên quan đến việc thúc đẩy các tài
liệu hay chất sử dụng trong quá trình sản xuất, sản xuất linh kiện đồng thời
hoặc các sản phẩm phụ trong quá trình chế biến, hoặc ở dạng của dư lượng của
hỗn hợp.
(q) Không hợp lệ là chỉ chưa đạt được yêu cầu quy định.
(r) Sản phẩm là chỉ đề cập đến tổ thành, nguyên liệu sản xuất, thiết bị chế
biến, thành phẩm và thiết bị thu hồi.
(s) Chất lượng đề cập đến các tính chất chung và đặc tính của sự an toàn của
thiết bị, kể cả an toàn và hiệu năng.
(t) Kiểm toán chất lượng có nghĩa là một khoảng thời gian nhất định, có đủ tần
số và chất lượng hàng hoá sản xuất một hệ thống có tổ chức tự kiểm tra, chất
lượng hành vi hệ thống kiểm tra và xem kết quả của việc thực hiện các chương
trình hệ thống chất lượng để đảm bảo thực hiện hiệu quả các chương trình, đạt
mục tiêu hệ thống chất lượng.
(u) Chính sách chất lượng đề cập đến chỉ đạo và mục tiêu chất lượng của tổ chức
và do các nhân viên quản lý có trách nhiệm thiết lập.
(v) Hệ thống chất lượng đề cập đến tổ chức, trách nhiệm, quy trình, xử lý và
nguồn lực để kiểm tra việc kiểm soát chất lượng.
(w) Tái chế là việc chế biến, điều chỉnh, đổi mới, đóng gói lại và lưu trữ
thành phẩm, làm thay đổi đáng kể hiệu suất, các yêu cầu về an toàn hoặc sử dụng
thành phẩm.
(x) Phản công là đề cập đến việc áp dụng các biện pháp nhất định cho các sản
phẩm kém chất lượng để có thể đạt được các yêu cầu DMR được chỉ định trước khi
được phép phân phối.
(y) Thông số kỹ thuật là những yêu cầu mà sản xuất, chế biến, dịch vụ hoặc các
hoạt động khác phải tuân thủ.
(z) Hiệu lực có nghĩa là có thể chứng minh rằng nó luôn có thể đáp ứng một mục
đích cụ thể bằng cách kiểm tra và cung cấp các bằng chứng khách quan.
(1) Xác nhận quá trình đề cập đến các bằng chứng khách quan rằng các sản phẩm
gia công hoặc sản phẩm được sản xuất bởi quá trình này luôn đáp ứng các yêu cầu
kỹ thuật theo quy định.
(2) Chứng nhận thiết kế là chỉ bằng chứng khách quan rằng các đặc điểm kỹ thuật
của thiết bị phù hợp thống nhất với nhu cầu của người sử dụng và thiết kế.
(aa) Chứng nhận là chỉ xác minh rằng các yêu cầu cụ thể đã được đáp ứng bằng
kiểm tra và bằng chứng khách quan.
§820.5 Hệ thống chất
lượng
Mỗi nhà sản xuất phải thiết lập và duy trì một hệ thống chất lượng phù hợp với
các thiết bị y tế mà họ thiết kế hoặc sản xuất và đáp ứng các yêu cầu của quy
định này.
1.2 Yêu cầu về Hệ thống Chất lượng
§ 820.20 Trách nhiệm quản lý
(a) Cơ quan chức năng phương châm quản lý chất lượng phải thiết lập mục tiêu
chính sách chất lượng và cam kết chất lượng và đảm bảo rằng chính sách chất
lượng được hiểu, thực hiện và liên tục thực hiện ở tất cả các cấp của công ty.
(b) Cơ quan quản lý mỗi nhà sản xuất phải thiết lập và duy trì một tổ chức
thích hợp để đảm bảo thiết bị được thiết kế và sản xuất phù hợp với đặc điểm kỹ
thuật này.
(1) Trách nhiệm và quyền hạn; Mỗi nhà sản xuất phải chỉ định trách nhiệm, quyền
hạn và nhân viên tương ứng, những người có thể thực hiện quyền quản lý, thực
hiện và đánh giá hệ thống chất lượng một cách độc lập.
(2) Nhân viên; Mỗi nhà sản xuất phải có đủ nhân viên có trình độ, bao gồm cả
việc phân công nhân viên được đào tạo để quản lý, thực hiện, đánh giá và kiểm
toán chất lượng nội bộ, để đáp ứng các yêu cầu của quy tắc này.
(3) Đại diện của ban quản lý; Tổ chức quản lý chức năng chỉ định một trong số
họ làm đại diện của người quản lý và ghi rõ trong hồ sơ đại diện của người quản
lý phải thực hiện các nhiệm vụ và quyền hạn sau đây bất kể các nhiệm vụ khác
như thế nào:
i) Đảm bảo rằng các yêu cầu của đặc tả này được thiết lập và duy trì hiệu quả.
ii) Báo cáo với tổ chức quản lý về tình trạng của hệ thống chất lượng để thảo
luận.
(c) Đánh giá quản lý; Cơ quan chức năng quản lý phải thiết lập một chương trình
để tính ứng dụng và tính hiệu quả hệ thống đánh giá chất lượng định kỳ đầy đủ.
Để đảm bảo rằng hệ thống chất lượng đạt được các yêu cầu của tiêu chuẩn này và
các nhà sản xuất thành lập phương châm và mục tiêu về chất lượng, ngày đánh giá
và kết quả hình thành tệp tài liệu.
(d) Chính sách chất lượng; Mỗi nhà sản xuất phải lập kế hoạch chất lượng, xác
định thực tiễn chất lượng có liên quan đến xác định và thiết kế và chế tạo,
nhân viên và phương pháp sửa chữa, và thành lập đạt được quy hoạch yêu cầu chất
lượng.
(e) Chương trình hệ thống chất lượng; Mỗi nhà sản xuất phải thiết lập một loạt
các chương trình và hướng dẫn thực hiện cho hệ thống chất lượng và hình thành
một văn bản.
§820.22 Kiểm toán Chất lượng
Mỗi nhà sản xuất phải thiết lập một chương trình kiểm toán chất lượng và quản
lý để đảm bảo rằng hệ thống chất lượng phù hợp với yêu cầu xây dựng hệ thống
chất lượng , để xác định hiệu quả của hệ thống chất lượng. Kiểm toán chất lượng
do sự vật kiểm toán, người phụ trách không trực tiếp thực hiện. Nếu cần thiết
thì áp dụng những biện pháp sửa chữa sai lầm, trong đó có những thứ không hoàn
thiện tiến hành kiểm toán. Cơ quan quản lý đối với kết quả kiểm toán các sản
phẩm và trường hợp tiến hành kiểm toán lại. Cung cấp ngày và kết quả kiểm toán
chất lượng và văn kiện có liên quan đến kiểm toán lại .
§820.25 Tất cả nhân viên
(a) Các yêu cầu chung tất cả các nhà sản xuất cần có đủ nhân viên, có trình độ
học vấn, nền tảng, đào tạo và kinh nghiệm cần thiết để đảm bảo rằng tất cả các
nhiệm vụ được yêu cầu bởi mục này đều được thực hiện đúng.
(b) Đào tạo; Mỗi nhà sản xuất phải thiết lập một chương trình đào tạo cần thiết
để đảm bảo rằng tất cả các nhân viên đều có đủ năng lực để thực hiện nhiệm vụ
của mình sau khi đào tạo và cung cấp tài liệu liên quan đến việc đào tạo.
(1) Nội dung đào tạo cũng bao gồm khiến tất cả nhân viên hiểu rằng do việc thực
hiện sai công việc được chỉ định có thể gây ra lỗi trong thiết bị.
(2) Để cho phép tất cả nhân viên làm việc về xác minh và xác nhận để dự đoán

1.3 Kiểm soát thiết kế
§ 820,30 Kiểm soát thiết kế
(a) Tổng quát
(1) Nhà sản xuất các thiết bị loại I và loại II, và tại quy định này (a)(2)
liệt kê các thiết bị loại I, một phương pháp để kiểm soát các công cụ và cần
được thành lập để duy trì thiết kế để đảm bảo rằng đạt được những yêu cầu đặc
biệt.
(2) Các thiết bị loại I sau đây cũng yêu cầu kiểm soát thiết kế.
i) Tự động hoá phần mềm máy tính.
ii) Thiết bị được liệt kê dưới đây:
(b) Kế hoạch thiết kế và phát triển Các nhà sản xuất có trách nhiệm lập và duy
trì các kế hoạch và các hoạt động phát triển liên quan đến việc thiết kế và
thực hiện các quy định của nhiệm vụ. Quy định kế hoạch cung cấp hoặc thiết kế
nhập và phát triển kế hoạch không giống nhau hoặc trao đổi thông tin của hành
vi. Đối với Kế hoạch tiến hành kiểm tra, xử lý theo phương pháp hiện đại và xác
nhận tiến độ thiết kế và phát triển.
(c) Thiết kế nhập từ các nhà sản xuất khác nhau có trách nhiệm lập và duy trì
yêu cầu thiết kế đảm bảo chương trình thích hợp để sử dụng thiết bị chủ yếu bao
gồm các nhu cầu của người sử dụng và bệnh nhân. Chương trình này nên bao gồm
các yêu cầu không đầy đủ, không rõ ràng hoặc không phù hợp . Các yêu cầu đầu
vào thiết kế phải được ghi lại trong hồ sơ, và người chỉ định tiến hành kiểm

(d) Thiết kế đầu ra; Các nhà sản xuất khác nhau có trách nhiệm lập và duy trì
các chương trình trên việc xác định và cung cấp thiết kế của thiết bị đầu ra,
và đánh giá phù hợp các yêu cầu thiết kế thi đầu vào của chương trình. Chương
trình thiết kế xuất bao hàm hoặc chế định tham chiếu tiêu chuẩn chứng nhận, và
đảm bảo rằng thiết kế đầu ra là giám định máy móc có tính năng tốt cần thiết
của thiết bị. Thiết kế đầu ra phải được ghi lại trong hồ sơ, được xem xét trước
khi phê duyệt, và cung cấp các tài liệu liên quan đến ngày kiểm toán và chữ
ký.
(e) Đánh giá thiết kế; Mỗi nhà sản xuất nên thiết lập và duy trì một bộ thủ tục
để đảm bảo thiết kế và phát triển thiết bị trong những giai đoạn thích hợp, dựa
vào kết quả chương trình đánh giá thiết kế, và cung cấp một tệp chính thức.
Những người tham gia đánh giá bao gồm các chuyên gia thiết kế đối với người đại
diện phụ trách giai đoạn thiết kế và người chịu trách nhiệm trực tiếp với giai
đoạn thiết kế thứ 5 và các chuyên gia bắt buộc. Kết quả đánh giá thiết kế bao
gồm giám định thiết kế, nhân viên đánh giá và ngày tháng, đều được ghi vào tập
tin lịch sử thiết kế (DHF).
(f) Kiểm nghiệm thiết kế; Các nhà sản xuất có trách nhiệm lập và duy trì thẩm
định chương trình thiết kế thiết bị. Kiểm nghiệm thiết kế nên chứng minh thiết
kế thiết kế xuất đến được yêu cầu thiết kế nhập. Kết quả kiểm nghiệm thiết kế,
bao gồm phương pháp giám định thiết kế, nhân viên kiểm nghiệm và ngày tháng,
đều được ghi vào tập tin DHF .
(g) Xác nhận thiết kế; Các nhà sản xuất nên thành lập và duy trì chương trình
xác nhận thiết kế. Nên ở những điều kiện thao tác dưới đây, đối với sản xuất
thử đơn lẻ, sản phẩm số lượng lớn hoặc số lượng tương đương các sản phẩm được
thiết kế để xác nhận sự thừa nhận. Thiết kế Chứng nhận phải đảm bảo rằng các
thiết bị người dùng thỏa mãn nhu cầu, và có mục đích sử dụng, sản phẩm cũng nên
bao gồm thực tế hoặc dự kiến trong điều kiện kiểm tra xác nhận thiết kế sử
dụng. Bao gồm xác nhận phần mềm và phân tích rủi ro khi phù hợp với kết quả xác
nhận thiết kế, bao gồm xác định các thiết kế và thiết kế phương pháp trong nhân
viên điều hành và ngày tháng phải được ghi vào hồ sơ DHF.
(h) Thiết kế chuyển đổi; Các nhà sản xuất phải thiết lập và duy trì một bộ
chương trình để đảm bảo tính chính xác của thiết kế, thể hiện trong một quy
phạm sản xuất nhất định.
(i) Thay đổi thiết kế; Các nhà sản xuất có trách nhiệm lập và duy trì một
chương trình thay đổi thiết kế; được xác định trước khi thực hiện, hiệu quả của
thiết bị hoặc cung cấp một nơi thích hợp để xác minh, xem xét và phê duyệt.
(j) Tập tin lịch sử thiết kế; Các nhà sản xuất sẽ thiết lập và duy trì các loại
thiết bị DHF. DHF sẽ chứa hoặc tham khảo các hồ sơ ban đầu cần thiết để chứng
minh rằng việc thiết kế và phát triển quy trình phù hợp với phương án thiết kế
đã được phê duyệt, và tuân thủ các yêu cầu quy định.
1.4 Kiểm soát văn kiện
§ 820.40 Kiểm soát văn kiện
Các nhà sản xuất phải thiết lập và duy trì đầy đủ các yêu cầu chương trình kiểm
soát văn kiện. Chương trình sẽ cung cấp những điều sau:
(a) Chứng nhận văn bản và tuyên bố Các nhà sản xuất có trách nhiệm, trước khi
phân phối đạt tất cả các văn bản theo yêu cầu của quy định, chỉ định một người
nào đó để kiểm tra sự phù hợp của tình hình . Cung cấp các văn kiện có liên
quan về ngày xác nhận và chữ ký cá nhân . Tiếp cận các yêu cầu của quy định này
Áp dụng cho các vị trí được chỉ định, sử dụng hoặc nơi yêu cầu khác. Tất cả các
tài liệu không thành công phải được loại bỏ khỏi điều khoản sử dụng.
(b) Sửa đổi tệp; Sửa đổi tệp là do chấp hành kiểm tra tài liệu gốc và sự chấp
thuận của người dân trong phạm vi phòng ban chức năng tương tự nên thực hiện
kiểm tra và phê duyệt, trừ khi ứng cử viên có quy định khác một cách rõ ràng.
Thay đổi được phê duyệt nên được thông báo kịp thời cho người có liên quan. Mỗi
nhà sản xuất có trách nhiệm giữ lại thay đổi các tập tin. Thay đổi hồ sơ phải
bao gồm nội dung, xác định các tài liệu liên quan, nhận chữ ký, ngày tháng và
ngày phê duyệt, ngày thay đổi có hiệu lực.
1.5 Kiểm soát thu mua
§ 820.50 Kiểm soát thu mua
Mỗi nhà sản xuất phải thiết lập và duy trì một chương trình đảm bảo rằng tất cả
các sản phẩm và dịch vụ đã mua hoặc nhận được đều đáp ứng các yêu cầu cụ thể.
(a) Đánh giá đối với các nhà cung cấp, nhà thầu và các cơ quan tư vấn Mỗi nhà
sản xuất phải thiết lập một bộ các yêu cầu cụ thể mà nhà cung cấp, nhà thầu và
các cơ quan tư vấn phải đáp ứng.
(1) Theo yêu cầu quy định (bao gồm cả yêu cầu về chất lượng), đánh giá và lựa
chọn nhà cung cấp tiềm năng, nhà thầu và các cơ quan tư vấn.
(2) Dựa trên kết quả đánh giá, xác định cách thức và mức độ kiểm soát của sản
phẩm, dịch vụ, nhà cung cấp, nhà thầu và các cơ quan tư vấn.
(3) Thiết lập và duy trì hồ sơ của nhà cung cấp, nhà thầu và các cơ quan tư vấn
chấp nhận được.
(b) Thông tin thu mua mỗi nhà sản xuất phải mua hoặc nhận sản phẩm và dịch vụ
để thiết lập và lưu giữ thông tin về việc có yêu cầu chất lượng. Nếu có thể,
bao gồm một thỏa thuận về các nhà cung cấp, nhà thầu và tư vấn đồng ý thông báo
sản xuất kinh doanh, thay đổi sản phẩm hoặc dịch vụ của họ, một nhà sản xuất có
thể xác định những thay đổi này sẽ ảnh hưởng đến chất lượng của thiết bị đã
hoàn thành. Thông tin thu mua nên được công nhận phù hợp với §820.40.
1.6 Nhận dạng và truy xuất
§820,60 Nhận dạng
Mỗi nhà sản xuất phải thiết lập và duy trì một chương trình nhận dạng sản phẩm
tại mỗi giai đoạn nhận, sản xuất, phân phối và lắp đặt để tránh nhầm lẫn.
§820.65 Truy xuất
Đối với sản xuất ngoại khoa máy móc thiết bị cấy ghép vào cơ thể người, hỗ trợ
hoặc duy trì mạng sống và dựa vào nhà sản xuất cung cấp cách sử dụng rõ ràng
chính xác lúc sử dụng, nếu thiết bị hoạt động thất bại, gây ra tổn thương
nghiêm trọng cho người sử dụng, nên thành lập và duy trì đối với mỗi cái hoặc
mỗi lô sản phẩm đều có chương trình nhận dạng duy nhất.Các chương trình nên dần
dần có những biện pháp khắc phụ sai lầm . Loại nhận dạng này bao gồm trong tập
tin lịch sử thiết kế.
1.7 Sản xuất và chương trình kiểm soát
§ 820.70 Sản xuất và chương trình kiểm soát
(a) Tổng quát
Mỗi nhà sản xuất có
trách nhiệm xây dựng, thực hiện, giám sát và kiểm soát quá trình sản xuất để
đảm bảo phù hợp với thiết bị tuân thủ quy định này.Trong quá trình sản xuất gia
công có thể sẽ phát sinh sai lầm, các nhà sản xuất phải thiết lập và duy trì
quá trình trình tự sản xuất cần thiết, quy trình trình tự sản xuất phải bao
gồm:
(1) Cung cấp hướng dẫn, quy trình vận hành tiêu chuẩn (SOP's), các phương pháp
chứng nhận và phương pháp kiểm soát sản xuất;
(2) Theo dõi và kiểm soát các thông số quy trình và đặc điểm sản phẩm trong quá
trình sản xuất;
(3) Tiêu chuẩn hoặc số tham chiếu được chỉ định;
(4) Chấp nhận gia công và thiết bị gia công;
(5) Yêu cầu về quy trình phải được mô tả trong hồ sơ quy trình hoặc bằng cách
sử dụng các mẫu đại diện đã được xác định và phê duyệt.
(b) Thay đổi quá trình và sản xuất Các nhà sản xuất thành lập và duy trì thay
đổi quy tắc, phương pháp, gia công hoặc các bước thực hiện. Những thay đổi này
trước khi chấp hành được kiểm nhận hoặc phù hợp với các thay đổi §820.75 khiến
thay đổi có hiệu quả . Những hành vi này, cần được ghi lại trong hồ sơ, thay
đổi sẽ được công nhận theo quy định tại § 820.40.
(c) Kiểm soát môi trường cho rằng điều kiện môi trường xung quanh có ảnh hưởng
xấu đến chất lượng sản phẩm, nhà sản xuất phải thiết lập và duy trì kiểm soát
thích hợp chương trình kiểm soát môi trường. Hệ thống kiểm soát môi trường định
kỳ, bao gồm cả các thiết bị cần thiết phù hợp, và đang đóng một vai trò tốt.
Kiểm tra phải được ghi lại trong hồ sơ.
(d) Nhân viên Nếu lý do cho rằng nhân viên và sản phẩm hoặc sự tiếp xúc với môi
trường có ảnh hưởng xấu đến chất lượng sản phẩm, mỗi nhà sản xuất có trách
nhiệm lập và duy trì sức khỏe của người lao động, thói quen vệ sinh, hành vi và
yêu cầu trang phục. Mỗi nhà sản xuất cần đảm bảo rằng những người khác tạm thời
làm việc trong môi trường được chỉ định được đào tạo hoặc giám sát bởi những
người được đào tạo.
(e) Kiểm soát ô nhiễm Mỗi nhà sản xuất phải thiết lập và duy trì một chương
trình để ngăn chặn thiết bị hoặc sản phẩm gây ô nhiễm các chất ảnh hưởng xấu
đến chất lượng sản phẩm.
(f) Nhà xưởng Nên thiết kế những nhà xưởng phù hợp, có đầy đủ không gian tiến
hành vận hành, và phòng ngừa hỗn loạn, và bảo đảm thao tác có trật tự.
(g) Thiết bị Mỗi nhà sản xuất thiết bị phải đảm bảo rằng tất cả các thiết bị sử
dụng trong quá trình sản xuất gia công là để đạt được các yêu cầu quy định và
thiết kế phù hợp, xây dựng, đặt và duy trì để tạo điều kiện lắp đặt, vận hành,
làm sạch và sử dụng.
(1) Bảng kế hoạch bảo dưỡng Mỗi nhà sản xuất có trách nhiệm lập và duy trì vận
hành, làm sạch và chương trình bảo trì các thiết bị khác, để đảm bảo đảm quy
phạm sản xuất. Hành vi bảo trì, bao gồm ngày tháng thực hiện bảo dưỡng và duy
trì nhân sự nên tiến hành ghi trong hồ sơ.
(2) Kiểm tra Các nhà sản xuất phải được thiết lập phù hợp với các chương trình
kiểm tra thường xuyên để đảm bảo chương trình bảo trì thiết bị toàn bộ. Ngày
kiểm tra và nhân viên chấp hành nên được ghi vào hồ sơ.
(3) Mỗi nhà sản xuất có trách nhiệm gỡ lỗi thiết bị và điều chỉnh các giới hạn
của sự khoan dung cho phép trên thiết bị nhà sản xuất hướng dẫn yêu cầu gỡ lỗi
thường xuyên (hoặc gần), hoặc những người tham gia vào vận hành đội ngũ nhân
viên có sẵn lời giải thích.
(h) Sản phẩm phụ của quá trình gia công trong trường hợp lý do để tin rằng một
sản phẩm phụ của một quá trình có ảnh hưởng xấu đến chất lượng sản phẩm, mỗi
nhà sản xuất có trách nhiệm lập và duy trì loại trừ việc sử dụng và các chương
trình sản phẩm phụ để đảm bảo rằng đã loại trừ hoặc giảm xuống một lượng không
ảnh hưởng xấu đến chất lượng của sản phẩm. Loại trừ hoặc giảm sản phẩm phụ của
quy trình phải được ghi lại.
(i) Xử lý tự động hóa đối với sản xuất hoặc hệ thống chất lượng đều dùng máy
tính hoặc hệt hống xử lý tài liệu tự động hóa, nhà sản xuất dựa theo hiệp định
đã ký về phần mềm máy tính có phải công dụng như đã tính không. Sửa đổi phần
mềm để kiểm tra hiệu quả trước khi được phê duyệt và công bố. Quá trình xác
nhận các kết quả phải được ghi lại trong hồ sơ.
§ 820.72 Thiết bị kiểm tra, đo lường và thí nghiệm
(a) Kiểm soát kiểm nghiệm, đo lường và thiết bị thực nghiệm từ các nhà sản xuất
khác nhau có trách nhiệm đảm bảo rằng tất cả các kiểm tra, đo lường và thử
nghiệm thiết bị, bao gồm cơ khí, kiểm tra điện tử hoặc tự động và thiết bị thử
nghiệm, phù hợp với mục đích, và có khả năng sản xuất , các sản phẩm có giá
trị. Mỗi nhà sản xuất có trách nhiệm lập và duy trì các chương trình trên
thường xuyên bảo đảm hiệu chuẩn, thử nghiệm, kiểm tra và bảo trì các thiết bị.
chương trình sẽ bao gồm việc cung cấp cho các thiết bị hoạt động, bảo vệ và lưu
trữ để duy trì độ chính xác thực tế và chính xác. Nội dung nên liên quan ghi
lại trong hồ sơ.
(b) Hiệu chuẩn chương trình hiệu chuẩn nên bao gồm hướng dẫn và giới hạn về độ
chính xác và độ tinh vi, giới hạn cần được thực hiện để thiết lập lại một
phương pháp hiệu quả, và để đánh giá chất lượng của các thiết bị có tác động
bất lợi hay không, nội dung liên quan được ghi trong vào hồ sơ.
(1) Tiêu chuẩn hiệu chuẩn để thử nghiệm, đo lường và hiệu chuẩn thiết bị phòng
thí nghiệm tiêu chuẩn nên tham khảo các tiêu chuẩn quốc gia hoặc quốc tế. Nếu
không được áp dụng tiêu chuẩn quốc gia hoặc quốc tế hoặc không có sẵn, các nhà
sản xuất phải sử dụng một bản sao tự trị tiêu chuẩn. Nếu không có tiêu chuẩn có
sẵn sự tồn tại, các nhà sản xuất nên thiết lập và duy trì một tiêu chuẩn thực
hiện nội bộ.
(2) Ghi chép hiệu chuẩn thiết bị giám định, ngày hiệu chuẩn, người thi hành mỗi
lần hiệu chuẩn và ngày hiệu chuẩn tiếp theo, được ghi vào hồ sơ cá nhân. Những
hồ sơ này phải được đặt trong (hoặc gần) trên mỗi thiết bị, hoặc người sử dụng
thiết bị và người sử dụng thiết bị hiệu chuẩn đều phải ghi lại vào hồ sơ.
§820.75 Xác nhận quy trình
(a) Khi kết quả của quá trình không thể được xác minh đầy đủ bằng bài kiểm tra
xác minh tiếp theo , nên thiết lập tiêu chuẩn cao về đảm bảo và chương trình
kiểm định chất lượng các công trình xác nhận quá trình và kết quả, ngày và chữ
ký người phê chuẩn, các thiết bị cần thiết, là nên được ghi lại trong hồ sơ.
(b) Mỗi nhà sản xuất phải thiết lập và duy trì một thủ tục để phát hiện và kiểm
soát các thông số của quá trình xác nhận để đảm bảo rằng các yêu cầu cụ thể
được đáp ứng liên tục.
(1) Mỗi nhà sản xuất phải đảm bảo rằng do người hạn định hoàn thành quá trình
xác nhận.
(2) Các quy trình, dữ liệu, phương pháp xác minh, giám sát và kiểm soát, ngày
thực hiện, người vận hành hoàn thành quá trình xác nhận nếu cần thiết, hoặc
thiết bị chính được sử dụng phải được ghi vào hồ sơ.
(c) Khi quá trình này là để xác nhận thay đổi hoặc sai lệch, các nhà sản xuất
kiểm tra để xác nhận và đánh giá quá trình này, nếu cần thiết, để làm xác nhận
lại . Đối với nội dung có liên quan nên được ghi vào hồ sơ.
1,8 Hoạt động được công nhận
§ 820.80 Xác nhận nhập hàng, quá trình gia công và thành phẩm
(a) Tổng quát Các nhà sản xuất phải thiết lập và duy trì các thủ tục được chấp
thuận. Công nhận bao gồm kiểm tra, thử nghiệm hoặc các hoạt động xác minh khác.
(b) Hành vi xác nhận nhập hàng Các nhà sản xuất thành lập và duy trì chương
trình tiếp nhận sản phẩm tiến vào xông xưởng. Chấp nhận thành các sản phẩm của
nhà máy phải được kiểm tra, kiểm tra hoặc xác minh khác để đáp ứng các yêu cầu
quy định. Phê duyệt và từ chối được ghi vào hồ sơ cá nhân.
(c)Hành vi xác nhận sản phẩm trong quá trình gia công, Trong thời gian
tới, mỗi nhà sản xuất phải thiết lập và duy trì một quy trình phê duyệt đảm bảo
rằng sản phẩm trong quá trình đáp ứng các yêu cầu cụ thể. Loại hình thức này
hoàn thành yêu cầu kiểm nghiệm, thực nghiệm hoặc hành vi thực nghiệm khác, hoặc
là trước khi nhận được xác nhận chứng minh, nên bảo đảm quá trình gia công kiểm
soát sản phẩm, và ghi chép lại.
(d) Hành vi xác nhận thành phẩm Các nhà sản xuất nên thành lập và duy trì
chương trình xác nhận thành phẩm, để đảm bảo các thể hoặc thành phẩm theo lô
đạt được tiêu chuẩn xác nhận. Xong một công nhận trước khi được đặt trong sự cô
lập, hoặc nếu không kiểm soát phù hợp thành phẩm đáp ứng các yêu cầu sau , có
thể được phân phối: để hoàn thành các yêu cầu DMR, truy cập vào các thông tin
có liên quan và các tập tin, người được chỉ định để chấp thuận giấy phép và chữ
ký, chú ý ngày phê duyệt.
(e) Ghi chép được công nhận Các nhà sản xuất nên đưa những hành vi được công
nhận ghi chép vào các hồ sơ. Những hồ sơ này bao gồm: công nhận hành vi thực
hiện, ngày thực hiện, kết quả, việc thực hiện các hành động đã được phê duyệt
chữ ký cá nhân, sử dụng hợp lý các thiết bị. Những ghi chép này nên được cho
vào một phần của nội dung DHR.
§ 820.86 Tình trạng chấp thuận
Mỗi nhà sản xuất có trách nhiệm một cách thích hợp thông qua tình trạng thử
nghiệm của sản phẩm, để cho biết các sản phẩm phù hợp với tiêu chuẩn công nhận
trong suốt quá trình sản xuất, đóng gói, dán nhãn, lắp đặt và dịch vụ về tình
trạng kiểm định chất lượng kiểm tra phải được chạy qua, để đảm bảo rằng chỉ
thông qua sự chấp nhận của sản phẩm để phân phối, sử dụng hoặc cài đặt.
1.9 Sản phẩm không hợp lệ
§ 820,90 Sản phẩm không hợp lệ
(a) Kiểm soát sản phẩm không hợp lệ Mỗi nhà sản xuất có trách nhiệm lập và duy
trì kiểm soát của chương trình sản phẩm không hợp lệ. Chương trình phải ghi rõ
việc xác định các sản phẩm không hợp lệ, ghi âm, đánh giá, phân loại và xử lý.
Đánh giá không hợp lệ bao gồm quyết định có phải yêu cầu điều tra hay không và
thông báo cho người chịu trách nhiệm hoặc cơ quan. Các đánh giá và điều tra
phải được ghi vào hồ sơ.
(b) Đánh giá và giải quyết sản phẩm không hợp lệ
(1) Mỗi nhà sản xuất có trách nhiệm lập và duy trì chương trình đánh giá và
giải quyết xử lý sản phẩm không hợp lệ. Chương trình cần được xem xét đánh giá
và giải quyết một cách minh bạch. Xử lý sản phẩm không phù nên được ghi vào hồ
sơ. Hồ sơ cũng bao gồm sản phẩm không hợp lệ và chữ ký của người phê duyệt .
(2) Mỗi nhà sản xuất có trách nhiệm lập và duy trì các chương trình sản xuất
lại, bao gồm cả kiểm tra lại và đánh giá lại sau khi làm lại sản phẩm không phù
hợp, để đảm bảo rằng các sản phẩm đáp ứng các tiêu chuẩn công nhận hiện nay.
Hành vi sản xuất lại và đánh giá, bao gồm quyết định sản xuất lại ảnh hường
không tốt tới các sản phẩm, nên được ghi lại trong hồ sơ DHR.
1.10 Các biện pháp phòng ngừa và điều chỉnh
§820.100 Các biện pháp phòng ngừa và điều chỉnh
Mỗi nhà sản xuất phải thiết lập và duy trì một chương trình để thực hiện các
biện pháp khắc phục và phòng ngừa, chương trình sẽ bao gồm các yêu cầu sau:
(1) Phân tích quá trình, hoạt động, nhượng bộ, báo cáo kiểm toán chất lượng, hồ
sơ dữ liệu chất lượng, hồ sơ dịch vụ, ý kiến, làm lại hoặc các nguồn khác để
xác định hiện hành và các nguyên nhân tiềm năng của sản phẩm không hợp lệ và
các vấn đề chất lượng khác. Khi cần thiết , Chúng ta phải sử dụng các phương
pháp thống kê để phân tích sự tái phát của các vấn đề chất lượng.
(2) Điều tra các nguyên nhân không đủ tiêu chuẩn liên quan đến quá trình sản
xuất và hệ thống chất lượng.
(3) Xác định các biện pháp cần thiết để sửa chữa và ngăn ngừa sự tái phát của
sản phẩm không phù hợp và các vấn đề về chất lượng khác.
(4) Xác minh rằng các biện pháp khắc phục và phòng ngừa có hiệu quả và không có
ảnh hưởng bất lợi đến thành phẩm.
(5) Các phương pháp và thủ tục để thực hiện và ghi chép các sửa đổi phải sửa
chữa và ngăn ngừa các vấn đề về chất lượng được xác định.
(6) Đảm bảo rằng thông tin có liên quan đến vấn đề chất lượng hoặc các sản phẩm
không phù hợp có thể được truyền đạt đến những người trực tiếp chịu trách nhiệm
đảm bảo chất lượng sản phẩm hoặc ngăn ngừa các vấn đề đó.
(7) Đưa ra các thông tin liên quan về các vấn đề chất lượng đã được xác định và
các biện pháp khắc phục và phòng ngừa cho cơ quan quản lý xem xét.
(8) Tất cả các biện pháp và kết quả của các biện pháp khắc phục và phòng ngừa
đều được ghi lại.
1.11 Kiểm soát nhãn dán và bao bì
§820.120 Nhãn thiết bị
Mỗi nhà sản xuất phải thiết lập và duy trì một chương trình kiểm soát
nhãn.
(a) Nhãn hoàn chỉnh Việc in và áp dụng nhãn phải được giữ hoàn chỉnh, và tất cả
các mặt hàng trong quá trình gia công, lưu trữ, vận chuyển, phân phối và sử
dụng phải được dán nhãn.

§820.1 Range

§820.5 Quality System
Each manufacturer shall establish and maintain a quality system suitable for
the medical devices they design or manufacture and meet the requirements of
this specification.
1.2 Quality System Requirements
§ 820.20 Management Responsibilities
(a) Quality Policy The management functional organization should establish
quality policy objectives and quality commitments, and ensure that the quality
policy is understood, implemented and continuously implemented at all levels of
the company.
(b) Management agencies Each manufacturer should establish and maintain an
appropriate organization to ensure that the device is designed and produced in
accordance with this specification.
(1) Responsibilities and Permissions Each manufacturer shall appoint
corresponding responsibilities, permissions, and personnel who can
independently exercise authority to manage, execute, and evaluate the quality
system.
(2) Personnel Each manufacturer shall have sufficient qualified personnel,
including the assignment of well-trained personnel for management, execution,
evaluation and internal quality audits, in order to achieve the requirements of
this Code.
(3) Representatives of the management The management functional organization
shall appoint one of them as the manager's representative and indicate it in
the file. The manager's representative must perform the following duties and

§820.22 Quality Audit
Each manufacturer shall establish a quality auditing program and perform
management to ensure that the quality system meets the established quality
system requirements and determine the validity of the quality system. The

§820.25 All staff

specification.
1.4 File Control
§ 820.40 File Control
Each manufacturer shall establish and maintain the full range of control
programs required by this specification. The program shall provide the
following:
(a) Approval and publication of documents Each manufacturer shall appoint a
person to examine the applicability and accreditation conditions before
distributing all the documents required by this Code. Documents concerning the
date of approval of the documents and the personal signature shall be provided.

schedule for commissioning, cleaning, and maintenance of other equipment to
ensure that production specifications are maintained. Maintenance activities,

be recorded in the file.
(2) Inspection Each manufacturer shall carry out regular inspections in
accordance with the established procedures to ensure that the equipment
maintenance plan is completed. The inspection date and the personnel performing

(3) Commissioning Each manufacturer shall place instructions for equipment
adjustment limits and allowable tolerances on equipment manufacturers (or
nearby) that require regular commissioning, or the staff involved in these
commissionings shall provide instructions.
(h) By-products of the process Where there are reasons to believe that the
by-products of a process have an adverse effect on product quality, each
manufacturer shall establish and maintain a process for the use and removal of

(i) Automated processing For computers or automated data processing systems
used in production or quality systems, manufacturers should verify that the
computer software has the intended use in accordance with the signed agreement.

§ 820.72 Inspection, Measurement and Experimental Equipment
(a) Inspection, measurement and control of laboratory equipment. Each
manufacturer shall ensure that all inspection, measurement and laboratory
equipment, including mechanical, automatic or electronic inspection and testing
equipment, is suitable for the desired purpose and has the ability to produce
valuable products. Each manufacturer shall establish and maintain a program for

§ 820.80 Receiving, processing and approval of finished products
(a) General The manufacturers shall establish and maintain approved procedures.

program for acceptance of incoming products. The products received into the

§ 820.86 Status of Approval
Each manufacturer shall inspect the approval status of the product in an

standard. The inspection of the accreditation status shall be conducted
throughout the entire process of manufacture, packaging, labelling,
installation and service of the product, so as to ensure that only approved

and preventive measures to the management agency for review.
(8) All measures and results of corrective and preventive measures are
documented.
1.11 Control of Labels and Packaging
§820.120 Device label
Each manufacturer shall establish and maintain a control label program.
(a) Label integrity The printing and application of the label should be kept
intact, and all items in the process, storage, handling, distribution and use
should be labeled.

(a) Each manufacturer shall establish and maintain a program for the control of
product storage sites and warehouses to prevent confusion, damage,
deterioration, pollution or other adverse effects prior to use and
distribution, and to ensure that no use or distribution is out of date,

§ 820.170 Installation

maintain appropriate installation and inspection instructions and appropriate

§ 820.186 Quality System Record
Each manufacturer shall maintain a quality system record (QSR). The QSR shall
include or specify the source of the program and the files required by this
specification, including but not limited to the designation of special types of
equipment. Records shall be made in accordance with the requirements of §
820.20.
Each manufacturer shall ensure that QSR is prepared and approved in accordance
with §820.40
§ 820.198 complaint file
(a) Each manufacturer shall retain the complaint file. Each manufacturer shall
establish and maintain a program for acceptance and review and evaluation of
complaints by officially designated units. The program shall ensure:
(1) Handling complaints in a unified and timely manner;
(2) Oral complaints received should be recorded in the file;
(3) In accordance with the medical device report that is governed by Section
803 or 804, complaints should be evaluated to determine whether the incident
represented by the complaint needs to be reported to the FDA.

United States, the records required by this specification should be conveyed to
one of the following locations in the United States: The United States entity
that officially maintains the manufacturer's records or the original
distribution site.
1.14 Service
§820.200 Service
(a) Where specified service is required, each manufacturer shall establish and
maintain instructions and procedures for implementing and verifying that the
service meets the specified requirements.
(b) Each manufacturer shall analyze the reports received in accordance with the
appropriate statistical methodology of § 820.100.
(c) In accordance with Section 803 or 804 of this Code, a service report
describing a matter must be reported to the FDA. The manufacturer receiving

1.1 概述
§820.1 範圍
(a) 適用性
(1) 在這個品質體系規範中描述了現行的生產管理規範的要求(CGMP). 本規範要求規定了所有醫用器械成品在設計,製造,包裝,標籤,貯存,安裝和服務中使用的方法,設施和控制.這些要求是為了確保醫療器械成品的安全和有效,並遵從美國食品,藥品和化妝品法.本規範提出了適用於醫療器械成品製造商的基本要求.如果某製造商只進行本規範規定的一部分操作,而不進行其他操作,則該製造商僅需執行適用於他所進行操作的那些要求.有關Ⅰ類器械,設計控制僅按在§820.30(a)(2)中列出的要求進行.這個規範不適用於成品元件和零件的製造商,但鼓勵這樣的製造商使用規範的適當規定作為指導.人類血液製品和血液成分的製造商不屬於本規範的管理範圍,但屬於606的管理範圍.
(2) 這一規範的規定適用于本規範定義的醫療器械成品,即使用的物件是人的,在美國各州或領地,哥倫比亞特別區或波多黎哥聯邦製造,進口或出口的器械成品.
(3) 在本規範中,幾次使用了短語”適當的地方”. 當要求以”適當的地方”來限制時,如果製造商沒有合理的理由來證明不適宜,就認為此要求是”適當的”. 如果不貫徹”適當的”要求,就會導致產品達不到要求或製造商不能採取某些必要的正確措施.
(b) 範圍 這一的品質體系規範和增補在這一規範其他節的條文明確注明用於其他方面的條文除外. 在不可能執行全部適用條文(包括這一節的和這一規範其他節的條文)的情況下,特定的運用於有問題器械的條文將取代其他一般的適用條文.
(c) 權威性 根據聯邦法501, 502, 510, 513, 514,
515, 518, 519, 520, 522, 701, 704, 801, 803, (21U.S.C.315, 352, 360, 360c,
360d, 360e, 360h, 360i, 360j, 360l, 371, 374, 381, 383) 建立和提出了820規範的權威性. 如果沒能執行適用規範,可能會導致產生偽劣器械, 根據法規501(h), 對這樣的器械和未能執行規範的人都要進行處罰.
(d) 外國製造商 如果某製造商提供給美國的進口器械,拒絕接受FDA對外國設備進行是否執行本規範的檢查,就會出現法規的801(a)節中的後果. 用這樣的設備生產出的任何器械,在設計,製造,包裝, 標籤,貯存,安裝或服務方面,使用方法,設備和控制都未遵從法規的520(f)節和本規範的要求. 根據法規501(h), 用這樣的設備製造出來的器械都屬於偽劣產品.
(e) 豁免或更改
(1) 任何希望豁免或更改執行某些器械品質體系要求的申請,都要遵從法規520(f)(2)的要求. 申請豁免或更改的過程將依據這一規範§10.30的程式進行,即FDA的管理程式. 以下地址可提供指導: 器械和放射衛生中心, 小製造商處(HFZ-220), 1350 Picca rd

(2) 當FDA判定某種更改有益於公眾健康時,
就會起草並認可這項更改. 這種更改僅能在一段時間內維持有效,
即當器械仍能滿足公眾健康需要, 並且如果沒有更改,器械不可能製造得非常有效的一段時間內.
§820.3 定義
(a)法指的是美國食品,藥品和化妝品法修正案(secs.201~903,
52Stat.1040 et seq., 修正版21U.S.C.321~394). 在法201中的全部定義都適用於本規定.
(b)投訴指的是以某些書面的,電子的或口頭的形式表達意見,
認為在配發後的器械在鑒定,品質,耐久性,可靠性,安全性,有效性或性能方面有缺陷.
(c)組成指的是原材料,物質,小件,零件,軟體,硬體,標籤或有包裝和標籤的成品器械的零配件.
(d)控制編號指的是有區別的符號,如字母或數位的不同組合,或以原製造,包裝,標籤和分發的單個或批量成品的區別符號來分辨.
(e)設計歷史文件(DHF)指的是描述某醫療器械成品設計過程的有關記錄.
(f)設計輸入是指作為器械設計基礎對器械的物理和特性要求.
(g)設計輸出是指各設計階段的設計成果和最終的總設計成果. 完成設計輸出包括器械,包裝和標籤,器械主記錄.
(h)設計評審是指依照依照檔進行廣泛,系統的設計評審, 以評價設計要求的適當性,並評價設計達到這些要求的能力,查明問題所在.
(i)器械歷史記錄(DHR)是指醫療器械成品製造過程的記錄.
(j)器械主記錄(DMR)是指包括醫療器械成品的程式和規範的完滿記錄.

(q)不合格是指未達到特定的要求.
(r)產品是指組成,製造材料,加工過程中器械,成品器械及返回器械.
(s)品質是指使器械安全適用的總性質和特徵,包括安全性和性能.
(t)品質審核是指在規定的時間間隔,以足夠的次數,對製造商品質體系進行有組織的自主的檢查,檢驗品質體系行為和結果是否執行品質體系程式,以保證有效地執行程式,達到品質體系目標.
(u)品質方針是指有關品質的機構方向和目標,是由負責的管理人員建立的.
(v)品質體系是指檢查品質管制的組織機構,職責,程式,處理和資源.
(w)再加工是指對成品器械進行加工,調節,革新,再包裝,再貯存,大大改變了成品器械的性能,安全性規範或用途.
(x)返工指的是對不合格產品採取某些措施,以使他在獲准配發之前達到指定的DMR要求.
(y)規範是指生產,加工,服務或其他行為必須遵守的一些要求.
(z)有效性是指通過檢查和提供客觀證據來證明能始終滿足特定的用途.
(1)過程確認是指通過客觀的證據證明加工生產出的產物或產品始終達到預定的規範.
(2)設計確認是指通過客觀的證據證明器械規範與使用者的需要和設計的用途相一致.
(aa)驗證是指通過檢查和提供客觀證據來證明已經滿足指定的要求.
§820.5 品質體系
各製造商應建立並保持一個品質體系,適合於他們設計或製造的醫療器械,並且達到本規範的要求.
1.2 品質體系要求
§820.20 管理職責
(a)品質方針 管理職能機構應建立品質方針目標和品質承諾,並保證品質方針在企業各級人員中的理解,貫徹和持續執行.
(b)管理機構 各製造商都應建立並維持一個適當的組織機構,以保證器械依照本規範進行設計和生產.
(1)職責和許可權 各製造商都應任命有相應職責,許可權和能獨立行使職權的人員負責管理,執行和評價品質體系.
(2)人員 各製造商都應具備足夠的合格人員,包括分派培訓有素的人員從事管理,執行,評價和內部品質審核等工作,以達到本規範要求.
(3)管理者代表 管理職能機構應任命其中一員為管理者代表,並在檔中注明.管理者代表不論其他職責如何,必須履行下列職責和權力:
i. 確保按本規範要求有效地建立和保持.
ii. 向管理機構彙報品質體系進行情況,供其討論.
(c)管理評審 管理職能機構應按照建立的程式,以足夠的次數定期評審品質體系的適用性和有效性. 以保證品質體系達到本規範要求和製造商建立的品質方針和目標,評審日期和結果應形成檔.
(d)品質策劃 各製造商應編制品質計畫,確定與設計和製造的器械相關的品質實踐,人員和措施,並建立達到品質要求的規劃.
(e)品質體系程式 各製造商應建立品質體系的各種程式和實施指南,並形成檔.
§820.22 品質審核
各製造商應建立品質審核的程式,並進行管理,以保證品質體系符合建立的品質體系要求,確定該品質體系的有效性.品質審核應由與審核事物無直接責任的人執行.若有必要時,應採取措施糾正錯誤措施,包括對有缺陷的事物進行再審核.管理機構對各品質審核的結果及再審核的情況進行覆核.提供品質審核日期和結果及再審核的有關文件.
§820.25 全體工作人員
(a)一般要求 各製造商都應具有足夠的工作人員,具備必需教育,背景,接受過培訓並富有經驗,以保證正確履行本節所要求的全部工作.
(b)培訓 各製造商應建立必需培訓的程式,保證全部工作人員在經過培訓後能勝任他們各自的職責,並提供與培訓有關的文件.
(1)培訓內容還包括使全體工作人員懂得由於錯誤執行指定工作可能會導致器械產生缺陷.
(2)使從事驗證和確認工作的全體工作人員能預見可能會發生的缺陷和錯誤.
1.3 設計控制
§820.30 設計控制
(a) 總則
(1) Ⅱ,III類器械的製造商,以及在本規範(a)(2)段列出的Ⅰ類器械製造商,應建立並保持控制器械設計的方法,以保證達到特定的要求.
(2) 下列Ⅰ類器械也需要設計控制.
i.電腦軟體的自動化機械.
ii.下面列出的器械:
(b)設計和開發計畫 各製造商應建立並保持有關設計和開發行為的計畫,並規定執行職責.計畫應規定提供或輸入設計和開發程式的不同組或行為的互換資訊.對計畫應進行檢查,用現代化手段處理並證實設計和開發的進展.
(c)設計輸入 各製造商應建立並保持關於保證器械的設計要求適當的程式,以器械用途為主,包括使用者和病人的需要.該程式應包括關於不完善,不清楚或抵觸要求的處理辦法.設計輸入要求應記錄在檔中,並由指定的人進行檢查和認可,並提供認可這些要求的日期和個人簽名的檔.
(d)設計輸出 各製造商應建立並保持關於確定和提供設計輸出檔的程式,並進行執行設計輸入要求的適當評價.設計輸出程式應包含或制定參照的認可標準,並保證那些設計輸出是鑒定器械良好性能所必需的.設計輸出應記錄在檔中,在獲准之前進行評審,並提供有關評審認可日期和簽名的文件.
(e)設計評審 各製造商應建立並保持一套程式, 保證在器械設計開發的適當階段,按計劃評審設計結果,並提供正式檔.評審參加者應包括設計的專業人員對設計階段負有責任的代表和與設計階段五直接責任的人和必要的專家.設計評審的結果包括設計鑒定,評審人員和日期,都應記錄在設計歷史檔(DHF)中.
(f)設計驗證 各製造商應建立並保持驗證器械設計的程式.設計驗證應證明設計輸出達到設計輸入要求.設計驗證的結果,包括設計方法的鑒定,驗證人員和日期,都應當記錄在DHF檔中.
(g)設計確認 各製造商應建立並保持設計確認的程式.應在規定的操作條件下,對試製的單個,批量產品或等同物進行設計確認的確認.設計確認應保證器械滿足使用者的需要,並具有預期用途,還應包括產品在實際或設想使用條件下的試驗.設計確認還應包括軟體確認及適當的時候的風險分析.有關設計確認的結果,包括對設計和設計方法的鑒定,執行人員和日期都應記錄在DHF檔中.
(h)設計轉換 各製造商應建立並保持一套程式以確保器械設計正確性體現在一定的生產規範中.
(i)設計更改 各製造商應建立並保持一套程式,對更改的設計在執行之前進行鑒定,提供有效性檔或適當的地方進行驗證,評審和認可.
(j)設計歷史檔 各製造商應建立並保持各種類型器械的DHF. DHF應包含或參照必要的原始記錄,來證明設計開發過程與認可的設計計畫一致,並遵守本規範要求.
1.4 文件控制
§820.40 文件控制
各製造商應建立並保持本規範所要求的全部檔控制的程式.程式應提供下列內容:
(a)檔認可和發佈 各製造商應在分發達到本規範要求的全部檔之前,委派專人檢查適用性和認可情況.應提供有關認可文件的日期和個人簽名的文件.達到本規範要求的檔適用於指定的,使用的或其他需要的地方,所有失效的檔應從使用條款中刪除.
(b)檔更改 更改檔應由執行原文件檢查和認可的同一職能部門內的人進行檢查和認可,除非有另外明確指定人選. 認可的改動應及時地轉達給有關人員.各製造商應保留更改檔的記錄. 更改記錄應包括修改內容,相關檔的鑒定,認可人的簽名,認可日期及更改生效的日期.
1.5 採購控制
§820.50 採購控制
各製造商應建立並保持確保所有購買的或收到的產品和服務符合指定要求的程式.
(a)對供應商,承包商和諮詢機構的評審 各製造商應建立一套供應商,承包商和諮詢機構必須達到的指定要求.各製造商應:
(1)根據指定要求(包括品質要求),評價和選擇潛在的供應商,承包商和諮詢機構.評價應記錄在檔中.
(2)根據評價結果,確定對產品,服務,供應商,承包商和諮詢機構實施控制的方式和程度.
(3)建立和保持可接受的供應商,承包商和諮詢機構的記錄.
(b)採購資料 各製造商應對採購的或收到的產品和服務建立並保留關於是否達到品質要求的資料.可能的話,應包括一份協議,關於供應商,承包商和諮詢機構同意告知製造商,他們的產品或服務的改變,是製造商可以判斷這些改變是否會影響成品器械的品質.採購資料應依照§820.40得到認可.
1.6 標識和可追溯性
§820.60 標識
各製造商為防止混亂應建立並保持在接收,製造,交付和安裝各階段的產品標識程式.
§820.65 可追溯性
對於生產外科植入人體,支援或維持生命的器械製造商和依照製造商提供的使用說明正確使用時,如果器械運行失敗可對使用者造成嚴重傷害,則應建立並保持對每個或每批產品都有唯一性標識的程式.程式應促進糾正錯誤措施.這種標識應包括在設計歷史檔中.
1.7 生產和程序控制
§820.70 生產和程序控制
(a)總則 各製造商應制定,實施,控制並監測生產過程,以保證器械遵守本規範. 在製造加工過程中可能會發生違反規範的地方,製造商應建立並保持必須的生產程序控制的程式,生產程序控制應包括:
(1)提供指導檔,標準操作程式(SOP’s),限定方法和生產控制方式;
(2)在生產過程中監測和控制加工參數和產品特徵;
(3)應遵守的指定參考標準或編號;
(4)加工和加工設備的認可;
(5)工藝要求應闡述在工藝檔中或用通過鑒定和認可的代表性樣品來表現.
(b)生產和過程的改變 各製造商應建立並保持改變規則,方法,加工或步驟的程式.這些改變在執行之前應被驗證或在適當時依照§820.75使改變有效,這些行為均應記錄在檔中.改變應依照§820.40得到認可.
(c)環境控制 在有理由認為周圍環境條件對產品品質有不利影響時,製造商應建立並保持適當控制環境條件的程式.應定期檢查環境控制系統,以核實該系統,包括必需設備的適當性,並正發揮著良好作用.檢查應記錄在檔中.
(d)工作人員 如果有理由認為工作人員和產品或環境的接觸對產品品質有不利影響時,各製造商應建立並保持對工作人員的健康,衛生習慣,行為和衣著的要求. 各製造商應保證在指定的環境下臨時工作的其他人員接受適當的訓練或由接受過訓練的人進行監督.
(e)污染控制 各製造商應建立並保持防止對產品品質有不良影響的物質污染設備或產品的程式.
(f)廠房 應該設計適當廠房,具有足夠的空間進行必須的操作,以防止混亂,並保證有序的操作.
(g)設備 各製造商應保證在製造加工過程中使用的全部設備都達到指定要求,並經過適當設計,建造,放置和安裝以利於保養,調試,清潔和使用.
(1)保養計畫表 各製造商應建立並保持調試,清潔和其他設備保養的計畫表,以保證達到生產規範.保養行為,包括執行保養行為的日期和人員應記錄在檔中.
(2)檢查 各製造商應依照建立的程式進行定期檢查,以保證完成設備保養計畫.檢查日期和執行人員應記錄在檔中.
(3)調試 各製造商應將設備調整限度和允許公差的說明放在需要定期調試的設備商(或附近),或者從事這些調試的工作人員都備有說明.
(h)加工過程的副產物 在有理由認為某加工過程的副產物對產品品質具有不利影響的情況下,各製造商應建立並保持使用和排除這種副產物的程式,以保證他被排除或減少到不會對產品品質有不利影響的量.排除或減少加工過程的副產物均應記錄在在檔中.
(i)自動化處理 對於生產或品質體系所用的電腦或自動化資料處理系統,製造商應依照已簽訂的協議書驗證電腦軟體是否具有預想的用途.修改的軟體驗證有效後方能批准和發佈.驗證過程和結果應記錄在檔中.
§820.72 檢驗,測量和實驗設備
(a)檢驗,測量和實驗設備的控制 各製造商應保證全部檢驗,測量和實驗設備,包括機械,自動化或電子的檢查和試驗設備,適合於期望的目的,並有能力生產有價值的產物.各製造商應建立並保持關於保證常規校準,檢驗,檢查和保養設備的程式.該程式應包括操作,防護和存放裝置的的規定,以保持實用的精密度和準確性.有關內容均應記錄在檔中.
(b)校準 校準程式應包括對準確度和精密度的準確說明和限值.當未達到準確度和精密度的限值時,應採取有效補救措施重建限值,並要評價是否對器械品質產生不利影響,有關內容要記錄在檔中.
(1)校準標準 用於檢驗,測量和實驗設備的校準標準應參照國家或國際標準.如果國家或國際標準不適用或不可得,製造商應使用一份自主的複製標準.如果沒有可用的標準存在,製造商應建立並保持一份內部執行標準.
(2)校準記錄 設備鑒定,校準日期,每次校準的執行人及下一次校準的日期,均應記錄在檔中.這些記錄應放在每台設備上(或附近),或者使用設備和校準設備的人都備有記錄.
§820.75 過程確認
(a)當過程的結果不能被隨後的核對總和試驗完全驗證時,應建立高標準的保證和認可程式使加工過程確認.過程確認和結果,執行日期和批准人的簽名,必要的設備,均應記錄在檔中.
(b)各製造商應建立並保持關於檢測和控制確認過程的過程參數的程式,以保證持續達到指定的要求.
(1)各製造商應保證由限定的人完成確認過程.
(2)確認過程,監測和控制方法及資料,執行日期,必要時完成確認過程的操作者或使用的主要設備均應記錄在檔中.
(c)當過程確認發生變化或偏差時,製造商應檢查並評價過程確認,必要時要使其再確認.有關內容應記錄在檔中.
1.8 認可行為
§820.80 進貨,加工過程和成品的認可
(a)總則 各製造商應建立並保持認可的程式.認可包括檢驗,試驗或其他驗證行為.
(b)進貨認可行為 各製造商應建立並保持認可接受進廠產品的程式.對接受進廠的產品應進行檢驗,試驗或其他驗證以達到指定要求.認可和拒絕均應記錄在檔中.
(c)加工過程中產品的認可行為 適當的時候,各製造商應建立並保持保證加工過程中的產品達到指定要求的認可程式.這種程式在完成要求的檢驗,試驗或其他驗證行為,或者收到必須的認可證明之前,應保證加工過程中產品控制,並記錄在檔中.
(d)成品認可行為 各製造商應建立並保持認可成品的程式,以保證單個或各批成品達到認可標準.成品在認可以前應隔離放置,或以其他方式適當控制.成品在達到以下要求時,才可進行分發:完成DMR的要求;查閱相關資料和檔;指定專人批准許可並簽名;注明批准日期.
(e)認可記錄 各製造商應將認可行為記錄在檔中.這些記錄應包括:執行的認可行為,執行日期,結果,執行認可行為的個人簽名,使用的適當設備.這些記錄應作為DHR的一部分內容.
§820.86 認可狀況
各製造商應以適當的方式檢驗產品的認可狀況,以指明產品是否符合認可標準.認可狀況的檢驗應貫穿整個產品製造,包裝,標籤,安裝和服務的過程,以保證只有通過認可的產品才能分發,使用或安裝.
1.9 不合格品
§820.90 不合格品
(a)不合格品控制 各製造商應建立並保持控制不合格產品的程式.程式中應寫明不合格品的標識,記錄,評價,隔離和處置.不合格評價包括確定是否需要調查並告知責任人或機構.評價和調查均應記錄在檔中.
(b)不合格品的評審和處置
(1)各製造商應建立並保持評審和批准處置不合格品的職責的程式.程式應闡明評審和處置過程.對不合格品的處置過程應記錄在檔中.檔還包括某不合格品是可用的依據及批准人簽名.
(2)各製造商應建立並保持返工的程式,包括對不合格品返工之後的複試和複評,以保證產品達到現行的認可規範.返工和複評行為,包括確定返工對產品的不良影響,均應記錄在DHR檔中.
1.10 糾正和預防措施
§820.100 糾正和預防措施
各製造商應建立和保持實施糾正和預防措施的程式,程式應包括下列要求:
(1)分析過程,操作,讓步,品質審核報告,品質記錄,服務記錄,意見,返工產品或其他來源的資料,以查明導致不合格品或其他品質問題的現存和潛在原因.必要的時候,要適當使用統計學方法分析會再發生的品質問題.
(2)調查與生產過程和品質體系有關的不合格原因.
(3)確定糾正和防止再發生不合格品和其他品質問題的必須措施.
(4)驗證糾正和防止措施是否有效,並對成品器械無不利影響.
(5)執行和記錄修改的方法和程式,必須糾正和預防查明的品質問題.
(6)保證與品質問題或不合格品有關的資訊能傳達給那些直接負責保證該產品品質或預防此類問題的有關人員.
(7)把查明的品質問題的相關資訊和糾正及預防措施提交管理機構評審.
(8)糾正和預防措施的全部措施及結果均記錄在檔中.
1.11 標籤和包裝的控制
§820.120 器械標籤
各製造商應建立和保持控制標籤的程式.
(a)標籤完整 標籤的印刷和應用應保持完整,並且在加工,貯存,搬運,分發和使用過程中的物品均應有標籤.
(b)標籤審查 指定專人審查標籤的準確性,若適用應包括正確的有效期,控制編號,儲存說明,搬運說明和其他附加的處理說明.
(c)標籤存儲 各製造商應以能夠正確鑒別標籤的方式儲存標籤,並防止混亂.
(d)標籤操作 各製造商應控制標籤和包裝操作以防止混亂.標籤和標籤操作的單個或批量產品均應記錄在DHR檔中.
(e)控制編號 按§820.65中要求,控制編號應在整個分發過程中附在器械上.
§820.130 器械包裝
各製造商應保證器械的包裝和運輸容器經一定設計和管理,能保護器械在加工,儲存,搬運和分發的通常情況下不致改變或損壞.
1.12 搬運,儲存,分發和安裝
§820.140 搬運
各製造商應建立並保持在搬運過程中防止發生混亂,損壞,變質,污染或其他對產品的不良影響的程式.
§820.150 儲存
(a)各製造商應建立並保持控制產品儲存場地和庫房的程式,以防止混淆,損壞,變質,污染或其他在使用和分發以前的不利影響,並保證不使用或分發過期的,廢棄的或變質的產品.為防止產品超過保質期,應以能促進貨品輪流發送的方式儲存,且貨架條件應合適.
(b)各製造商應建立並保持儲存場地的授權接收或發送方法的程式.
§820.160 分發
(a)各製造商應建立並保持控制分發成品的程式,以保證只分發被認可的器械,不分發已到期或變質的器械,並檢查訂單,以保證在器械分發之前無混亂和錯誤.
(b)各製造商應建立並保持分發記錄,包括下述內容:最初運送的位址和姓名,裝運器械的標識和數量,裝運日期,器械的控制編號.
§820.170 安裝
(a)需要安裝器械的各製造商應建立並保持適當的安裝和檢查說明書及適當的試驗程式.安裝說明書和程式隨器械一起分發或送給安裝者,說明書和程式應包括正確安裝的指導方法,使安裝後器械能正常使用.
(b)安裝器械的人應保證依照製造商的說明書和程式進行安裝,檢查和試驗,並應把檢查和說明正確安裝的試驗結果記錄在檔上.
1.13 記錄
§820.180 一般要求
本規範所要求的全部記錄應保存在製造機構或製造商的職能辦公室等其他地方和FDA指定執行審查的雇員手中.這種記錄包括那些審查機構中沒有保存的,均應由FDA雇員進行審查和複製.這些記錄應字跡清楚,小心保存,防止丟失.提倡把記錄保存在自動化的資料處理系統中.
(a)保密 製造商認為是機密的記錄可以進行標記,並協助FDA依照本規範20節公開信息條例判定該資訊是否可以保密.
(b)記錄保留時間 本規範所要求的全部記錄應保留與器械設計和期望壽命相等的時間,但從製造商進行商業分發之日算起,不能少於2年.
(c)其他 本規範不適用於§820.20 (c)管理評審和§820.22品質審核所要求的報告及§820.50(a) 供應商,承包商和諮詢機構的評價中的供應商審核報告,但適用於依照這些條款建立的程式.根據FDA指定雇員的要求,管理職能機構的雇員應保證書面寫出本規範所要求的已經執行並記錄在檔中的管理評審和品質審核,供應商審核,執行日期以及尚未實施的糾正措施.
§820.181 器械主記錄
各製造商應保留器械的主記錄(DMRS),並保證依照§820.40進行準備和認可.各類型器械的DMR應包括下列資訊或指明所在位置:器械標準包括相應的圖紙,組成,配方,元件標準和軟體標準;生產加工規範包括相應的設備規範,生產方法,生產程式和生產環境規範;品質保證程式和規範包括認可標準和使用的品質保證設備;包裝和標籤規範,包括使用和處理方法;安裝,保養和服務程式及方法.
§820.184 器械歷史記錄
各製造商應保留器械歷史記錄(DHR’S).各製造商應建立並保持關於保證各批或單個產品的DHR程式,以證明依照DMR和本規範要求製造器械.DHR應包括下列資訊或指明所在位置:製造日期,製造數量,分發數量,證明器械依照DMR製造的認可記錄,各生產單位的原始鑒定標籤和使用標籤,器械標識和使用的控制編號.
§820.186 品質體系記錄
各製造商應保存品質體系記錄(QSR).QSR應包括或指明程式的來源及本規範所要求形成的檔,包括但不局限於指定特殊類型的器械,根據§820.20的要求進行記錄.
各製造商應保證依照§820.40進行準備和認可QSR
§820.198 投訴檔案
(a)各製造商應保留投訴檔案.各製造商應建立並保持由正式指定的單位接受,查閱和評價投訴的程式.該程式應保證:
(1)用統一及時的方式處理投訴;
(2)收到的口頭投訴應記錄在檔案中;
(3)依照被規範803或804節的醫療器械報告,應評價投訴以確定這種投訴所代表的事件是否需要報告給FDA.
(b)各製造商應查閱並評價所有投訴,以確定是否需要進行調查.如果不進行調查,製造商應保存一份記錄,包括不進行調查的原因和負責人的簽名.
(c)各製造商應該檢查,評價,調查被投訴的器械,標籤或包裝是否未達到規範.
(d)依照本規範803或804節必須報告為FDA的投訴代表的時間,應由指定專人進行及時檢查,評價和調查,並應保存在投訴檔案的獨立部分或其他清楚的地方.根據§820.198(e)所要求的附加資訊,調查記錄應包括下列內容:器械是否達到規範要求;器械是否正在用於治療或診斷;是否部分器械與報告的事故或不良事件有關.
(e)當進行本規範內容的調查時,應由本節198(a)段中正式指定單位保存調查記錄.調查記錄應包括:器械名稱;收到投訴的日期;器械標識和使用的控制編號;投訴人姓名,地址和電話號碼;投訴的性質和細節;調查日期和結果;採取的糾正措施;對投訴的答覆.
(f)當製造商的正式指定處理投訴的單位設在與製造機構中分開的一個地方,調查的意見和調查記錄理應轉達給製造機構.
(g)如果製造商的正式指定單位設在美國以外,本規範所要求的記錄理應傳達給美國下列之一的地方: 正式保存製造商記錄的美國單位或最初分發地.
1.14 服務
§820.200 服務
(a)在指定要求提供服務的地方,各製造商應建立並保持關於實施並驗證服務達到指定要求的指示和程式.
(b)各製造商應依照§820.100的適當的統計方法學分析收到的報告.
(c)依照本規範803或804節,說明某件事的服務報告必須報告給FDA,收到這種報告的製造商應主動考慮到投訴檔案,並依照§820.198要求進行處理.
(d)服務報告應記錄在檔中,並包括:服務的器械名稱;器械標識和使用控制編號;服務日期,服務人員;已實施的服務內容;試驗和檢驗的資料資料.
1.15 統計技術
§820.250 統計技術
(a)適當的地方,各製造商應建立並保持鑒定過的有效統計技術的程式,統計技術用於建立確定,控制和驗證過程能力和產品特徵的認可.
(b)各製造商應建立並保持一套程式,以保證使用適當的抽樣方案,並保證發生變化時複查抽樣方案.記錄在檔中.
